Summary: WHEREAS, in response to the COVID-19 National Declaration of Emergency bids were electronically received on Tuesday October 26, 2021 after public advertisement for Cafeteria Equipment, bids were issued to twenty-seven (27) vendors with three (3) vendors responding; and

WHEREAS, in accordance with N.J.S.A. 18A:18A-4, the District shall award only by resolution of The Board of Education to the lowest responsive and responsible bidder(s) after public advertisement for bids; and

WHEREAS, the contract period shall be for a two (2) year period from date of award with the option to renew for one (1) additional two (2) year period; and

WHEREAS, the solicitation for Cafeteria Equipment included a pricing component for a percentage discount based on the suggested manufacturer sale retail price for various cafeteria equipment, and this award of contract will include those discounts; and

WHEREAS, the recommendation for award of term contracts were reviewed and approved by Dr. Tonya McGill, Executive Director of Food and Nutrition Services.

Recommendation to the Board: NOW THEREFORE BE IT RESOLVED that the Newark Board of Education accepts and approves the award of term contracts for Cafeteria Equipment for a two (2) year period from date of award with the option to renew for one (1) additional two (2) year period as follows:

A. BFA Foodservice Equipment, Boonton, NJ at a cost not to exceed $95,557.53
B. Douglas Equipment, Bluefield, WV at a cost not to exceed $128,333.48
C. Sam Tell and Son Inc., Farmingdale, NY at a cost not to exceed $113,544.93
Total contract award $337,435.94

EXPLANATION: To replace and or upgrade school cafeteria equipment. Subject to availability of funds.
