Summary:

WHEREAS a petition for due process has been filed against the Newark Board of Education (“Board”) in the New Jersey Department of Education Office of Special Education Programs, bearing the caption L.P.P. o/b/o. E.P. vs. Newark Board of Education, et al. and has been assigned Docket No. EDS 05483-21, Agency Ref. No. 2021-32878;
WHEREAS, in order to avoid protracted and costly proceedings, it is in the best interest of the Board and the school district to resolve the matter in accordance with terms presented to the Superintendent and the Legal Committee of the Board and set forth in a Settlement Agreement (“Agreement”);

NOW, THEREFORE, BE IT RESOLVED:
The Board hereby approves and authorizes settlement of the matter referenced herein in accordance with the terms set forth in the Agreement; authorizes the Board President to execute the Agreement on behalf of the Board; and authorizes the implementation of the Agreement, including the disbursement of funds, in accordance with its terms.
