Summary:
|
WHEREAS, Employee No. 41616 has received annual summative evaluation ratings warranting a tenure charge of Inefficiency;
WHEREAS, rather than submitting to a tenure charge of inefficiency, Employee No. 41616 has agreed to resign, effective November 1, 2022, and has agreed to relinquish his tenured employment by the Board and to waive and release any tenure or other rights and any claims he may have against the Board in accordance with the terms set forth herein; and the Superintendent has agreed to accept the resignation in accordance with such terms, subject to approval by the Board (such agreement referred herein as the “Settlement”);
WHEREAS, upon recommendation of the Superintendent, the Board finds that the Settlement is in the best interests of the Board and the public since it avoids an uncertain conclusion after protracted and costly tenure charge proceedings at the expense of the public;

NOW THEREFORE, BE IT RESOLVED that:
1. The Board hereby approves and accepts the Settlement in accordance with its terms, authorizes the Board President to execute the settlement agreement setting forth such terms, and directs its implementation;
2. The Board hereby accepts the resignation of Employee No. 41616, effective November 1, 2022; and the Board hereby waives the mandatory period of notice of such resignation;
3. The Board hereby approves administrative leave with pay for Employee No. 41616 for the period August 30, 2022 to October 31, 2022;
4. Employee No. 41616’s employment records shall be amended accordingly.
