Summary:
|
WHEREAS, in accordance with N.J.S.A. 18A:18A-5a(1), the Board is authorized to award a term contract of one year for professional services without advertising for bids or public bidding;
WHEREAS, the Board is in need of bond counsel;
WHEREAS, the firm of Wilentz Goldman & Spitzer PA has served as bond counsel in accordance with a professional service contract with terms including the following rates: preparation of election documents for an unsuccessful election, $1,000; preparation of election documents for a successful election, $2,000; services in connection with short-term bond anticipation notes, $.80/$1000 principal amount, minimum $3,500; services in connection with bond issuance, $5,000 + $1.10/$1,000 principal amount; minimum $10,000; services in connection with lease purchase financing, $5,000 + $1.00/$1,000 principal amount; minimum $10,000; and services in connection with refunding bond issuance, $10,000 + $1.10/$1,000 principal amount; and
WHEREAS, General Counsel recommends a one-year renewal of the professional services contract to Wilentz Goldman & Spitzer PA at the stated billing rates;

NOW, THEREFORE, BE IT RESOLVED that the Board hereby authorizes and approves a term contract for legal services to Wilentz Goldman & Spitzer PA to serve as bond counsel for the Board for the 2022-23 fiscal year at the billing rates stated above, subject to the availability of funds.
