WHEREAS, pursuant to the Individuals with Disabilities Act (the “IDEA”) and N.J.A.C. 6A:14, the Board of Education of the City of Newark, County of Essex (the “Board”) is required to provide appropriate educational services to classified special education students pursuant to the requirements in their Individualized Education Programs (IEPs) as well as services to students who are homeless.
WHEREAS, in certain circumstances, the Board does not offer the particular educational services necessary to appropriately service these students so that placements in schools outside of the school district are necessary;
WHEREAS, each out of district school location where a Board student is placed requires a corresponding tuition contract for each student in order for services to be provided to the student; and
WHEREAS, there are approximately ____ special education students which currently require out of district placements in order to appropriately service their IEPs, a number which may increase as the school year progresses.
NOW THEREFORE, BE IT RESOLVED that the Board does hereby approve the out of district placements for the 2025-26 school year as indicated in the attached list in an amount not to exceed $39,813,634.00. Subject to the availability of funds.
More Schools will be identified as students are placed
